You must have a mobile communications subscription with a participating mobile operator or otherwise have access to a mobile communications network for which we make the Services available in order to have full access to the Services. You must also provide all necessary hardware and software to connect to the Services, including, but not limited to, a mobile device that is compatible with the Service and has easy internet access. You shall be responsible for getting internet access (and all equipment required for such access) as well as paying any expenses associated with such use. Some wireless apps are only compatible with a limited number of mobile devices. To avoid disappointment, we recommend that you check your mobile device's compatibility before subscribing to the Services. You must make any changes to your equipment or software that are required by any upgrade of the Services at your own expense. Any new or additional features that augment or expand the current Services, including the release of new products and services, are subject to the Terms unless clearly indicated differently. You must also pay a subscription fee, which can be paid for various lengths of time and is automatically renewed if not cancelled. Any subscription-based Services will only be available to you for the duration of the subscription for which you have paid. When the subscription period expires, your rights to use and access the subscribed Services will automatically expire. The Services are supplied "as is" and "as available" at the time of use or consumption, and we disclaim all responsibility or guarantee if personal settings, information, or messages are not stored (on time), erased, or transmitted improperly. Regardless of whether you actually download or use the Service, the cost becomes due upon purchase of the subscription; the sole consideration for the fees shall be the supply of the right to download, receive, and/or use the Services. You are solely liable for any and all activities that take place as a result of your subscription. This includes, but is not limited to, ensuring timely payment of any fees, tariffs, or other charges associated with gaining access to the Services or any items and services made available through the Services. You undertake to report us right once if you suspect or become aware of unauthorized use of your subscription or any other security violation. You may not assign or transfer the contract or any of your contractual rights in any other way. We reserve the right, upon written notice to you, to assign our rights and duties under this contract, as well as any receivables arising from this contract, to a third party, provided that such assignment is undertaken on terms that are not less favorable to you than those set forth in these Terms. Payments made to the new service provider are only valid after a notice of the transfer of receivables has been issued.
To use the Services, you must be at least the legal age in your country of residence and have the approval of the bill payer to sign up for and use the Services on their behalf. To use this service, you must be at least 18 years old or have parental or guardian permission to do so.
You will be charged the applicable fees as mentioned in the site / service page for full access to the Service. The amount will be collected for each subscription period during which the contract is active. Unless otherwise specified, the charges will be billed via the mobile bill you get from your network's mobile operator or any other payment method you choose. Your cell provider may charge you separately for text messaging, internet access, or downloading. You will pay or reimburse us for all national, local, and other taxes, including but not limited to VAT, tax on games of chance, and any levies imposed in lieu thereof, that are based on the costs due for the use of the Services, whether levied now or in the future by international, European, national, or local authorities, or by any other body or bodies authorized to levy taxes. All costs, including those for current subscription contracts, are subject to change at any time without notification from us. If we make a change, we will give you adequate notice. If you do not agree to the additional fees (which will apply solely in the future), you may cancel your subscription with immediate effect upon termination.
You must register in order to ensure safe usage of the Services and payment of the appropriate fees. You agree to provide us with accurate and complete personal information ("Registered Information") at all times. We reserve the right to suspend or cancel your account and withhold current and future use of the Services, or any component thereof, if we have cause to suspect the Registered Information is not accurate or full, in our sole discretion. You are responsible for keeping any passwords and/or accounts supplied to you by us confidential, and you are entirely liable for any acts taken using your password or account. If you observe or suspect unauthorized use of your password or account, or any other breach of security, you must notify us immediately. We may grant you access to some Services without requiring you to register. In each situation, we use the means of identification that we believe acceptable, such as your mobile phone number, to identify you. You agree that we may collect, disclose, and utilize such information in line with the Privacy Policy.
Our Privacy Policy governs how we use your personal information. By agreeing to the Terms, you also agree to the manner we may treat your personal information as described in our Privacy Policy.
We reserve the right to put the Services on hold for repairs, maintenance, or upgrades. In this case, we will make every effort to keep the disruption brief and to cause you as little difficulty as possible. We have the right to change, suspend, or terminate the Services at any time without notice. You agree that we will not be liable to you or any third person if the Services are changed, suspended, or discontinued. We provide you a personal, limited, non-transferable, non-exclusive, revocable, and non-assignable license and permission to install the software and download the content in order to use the Services on a chosen suitable mobile device, and you accept this license and permission.
You agree that you will not, and will not allow others to, use the Services and Sites to upload, distribute, transmit, communicate, provide a link to, or publish any data, information, or material that:
You agree to hold us, our parent company, subsidiaries, related parties, affiliates, directors, licensors, and their representatives and employees ("Partners") harmless from and against any and all loss, liabilities, claims, lawsuits, demands, actions, or other proceedings brought against it by any third party due to, arising from, or related to (i) your use of the Services, the content, downloads, software, and Sites, and (ii) your violation of the Terms of Service. (iii) a violation of any law, rule, or the rights of a third party. You agree to pay any and all costs, damages, and expenses incurred by us in connection with or arising from any such claim, lawsuit, action, demand, or other process, including, without limitation, reasonable lawyers' fees and costs awarded against or otherwise incurred by us.
WE AND OUR PARTNERS DISCLAIM ANY AND ALL RESPONSIBILITY FOR ANY HARM CAUSED BY YOUR USE OF THE SERVICES, CONTENT, SOFTWARE, AND SITES. YOU AGREE AND UNDERSTAND THAT:
YOU AGREE THAT WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, LOSS OF BUSINESS INFORMATION, BUSINESS INTERRUPTION, AND THE LIKE) ARISING OUT OF YOUR USE, MISUSE, OR INABILITY TO USE THE SERVICES AND IF A JURISDICTION DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY SET FORTH HEREIN, OUR LIABILITY IS LIMITED TO THE EXTENT ALLOWED BY LAW IN THAT JURISDICTION. OUR OR PARTNERS' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION SHALL IN NO EVENT EXCEED $100.00.
